{"id":18145,"date":"2025-02-25T21:27:02","date_gmt":"2025-02-25T21:27:02","guid":{"rendered":"https:\/\/torontotribune.ca\/index.php\/2025\/02\/25\/saskatchewan-farmer-wants-supreme-court-to-hear-emoji-signature-case\/"},"modified":"2025-02-25T21:27:02","modified_gmt":"2025-02-25T21:27:02","slug":"saskatchewan-farmer-wants-supreme-court-to-hear-emoji-signature-case","status":"publish","type":"post","link":"https:\/\/torontotribune.ca\/index.php\/2025\/02\/25\/saskatchewan-farmer-wants-supreme-court-to-hear-emoji-signature-case\/","title":{"rendered":"Saskatchewan farmer wants Supreme Court to hear emoji signature case"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"\">\n<p>A court case involving a farmer and a thumbs up emoji could be heading to Canada\u2019s highest court.<\/p>\n<p><\/p>\n<p>After two unsuccessful challenges in Saskatchewan courtrooms, agriculture company Achter Land &amp; Cattle Ltd. is headed to the Supreme Court.<\/p>\n<p>In December, the court of appeal upheld a 2023 Court of King\u2019s Bench verdict that found a thumbs-up emoji met signature requirements and was a legally binding agreement between farmer Chris Achter and Kent Mickleborough, a grain buyer with Southwest Terminal (SWT).<\/p>\n<p>In March 2021, Mickleborough sent a text of the contract to Achter for a delivery of 87 tonnes of flax. The farmer responded with a thumbs-up emoji but no accompanying text.<\/p>\n<p>Achter didn\u2019t deliver the product, and the company took him to court for breaching the contract. The farmer was ordered to pay more than $82,000 plus interest and court costs to SWT.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad\">\n<p>Story continues below advertisement<\/p>\n<\/p><\/div>\n<p>\u201cThat was just one of several short confirmatory text messages that Mr. Achter habitually used to enter into contracts,\u201d SWT lawyer Joshia Morrison said.<\/p>\n<p>Achter had argued the emoji only indicated he had received the contract, and he didn\u2019t have time to read it over.<\/p>\n<div class=\"c-inlineSignup\" data-newsletter-inline=\"\">\n<div class=\"c-inlineSignup__image\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"170\" height=\"225\" loading=\"lazy\" src=\"https:\/\/globalnews.ca\/wp-content\/themes\/shaw-globalnews\/images\/skyline\/national.jpg\" alt=\"For news impacting Canada and around the world, sign up for breaking news alerts delivered directly to you when they happen.\"\/>\n\t\t\t\t<\/div>\n<div class=\"c-inlineSignup__content\">\n<h3>Get breaking National news<\/h3>\n<p>For news impacting Canada and around the world, sign up for breaking news alerts delivered directly to you when they happen.<\/p>\n<\/p><\/div>\n<\/p><\/div>\n<p>Mickleborough argued the emoji amounted to an agreement, because he had previously texted numerous contracts to Achter, who would then confirm them via text and fulfil the order.<\/p>\n<div class=\"c-tabs\">\n<p>\n\t\t\t<button role=\"tab\" class=\"c-tabs__tab c-tabs__tab--active\" type=\"button\">More on Canada<\/button><br \/>\n\t\t\t<button role=\"tab\" class=\"c-tabs__tab\" type=\"button\">More videos<\/button>\n\t\t<\/p>\n<\/p><\/div>\n<p>Legal expert Michael Ilg said the context of the previous business relationship is key to this case.<\/p>\n<p>\u201cWe don\u2019t want to get carried away to indicate that simply using an emoji locks you into a contract,\u201d Ilg said. \u201cIt has to be in context.
