{"id":16504,"date":"2025-02-14T00:09:23","date_gmt":"2025-02-14T00:09:23","guid":{"rendered":"https:\/\/torontotribune.ca\/index.php\/2025\/02\/14\/family-of-toronto-man-fatally-shot-in-2022-upset-about-not-criminally-responsible-defence-toronto\/"},"modified":"2025-02-14T00:09:23","modified_gmt":"2025-02-14T00:09:23","slug":"family-of-toronto-man-fatally-shot-in-2022-upset-about-not-criminally-responsible-defence-toronto","status":"publish","type":"post","link":"https:\/\/torontotribune.ca\/index.php\/2025\/02\/14\/family-of-toronto-man-fatally-shot-in-2022-upset-about-not-criminally-responsible-defence-toronto\/","title":{"rendered":"Family of Toronto man fatally shot in 2022 upset about not criminally responsible defence &#8211; Toronto"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"\">\n<p>Gars Kourjakian\u2019s brother and father have sat through four days of evidence at the first-degree murder trial for Devret Clarke and are upset by his defence that he\u2019s <a href=\"https:\/\/globalnews.ca\/tag\/not-criminally-responsible\">not criminally responsible<\/a> for the killing.<\/p>\n<p><\/p>\n<p>\u201cIt\u2019s just a little bit of disgust, to be honest with you, and the fact that we\u2019re trying to pawn this off as an NCR is just another failure of the system,\u201d Gars\u2019 brother Sevag Kourjakian told Global News outside the courthouse.<\/p>\n<p>It was Dec. 30, 2022, when 37-year-old Devret Clarke, a former neighbour of Kourjakian\u2019s, drove into the underground parkade behind Kourjakian, who had just pulled into his parking spot.<\/p>\n<p>As the 34-year-old husband and father was getting out of his vehicle with his four-year-old daughter, Clarke pulled up next to him and shot at Kourjakian from his vehicle. Kourjakian was struck in the neck and died at the scene. His daughter grabbed her father\u2019s cell phone, called her mother and told her that her father was dead.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad\">\n<p>Story continues below advertisement<\/p>\n<\/p><\/div>\n<p>\u201cWe hope she does not remember the traumatic events that did happen on that night and hopefully she\u2019s able to live a normal life moving forward,\u201d Sevag said, calling his niece courageous.<\/p>\n<div class=\"c-inlineSignup\" data-newsletter-inline=\"\">\n<div class=\"c-inlineSignup__image\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"170\" height=\"225\" loading=\"lazy\" src=\"https:\/\/globalnews.ca\/wp-content\/themes\/shaw-globalnews\/images\/skyline\/national.jpg\" alt=\"For news impacting Canada and around the world, sign up for breaking news alerts delivered directly to you when they happen.\"\/>\n\t\t\t\t<\/div>\n<div class=\"c-inlineSignup__content\">\n<h3>Get breaking National news<\/h3>\n<p>For news impacting Canada and around the world, sign up for breaking news alerts delivered directly to you when they happen.<\/p>\n<\/p><\/div>\n<\/p><\/div>\n<p>The Kourjakian family said they will not feel they have gotten justice for the unprovoked and deadly attack unless Clarke is found guilty of first-degree murder, but the defence is relying on evidence of two forensic psychiatrists who assessed Clarke on psychiatric disorders and the impact on criminal responsibility.<\/p>\n<p>Dr. Sumeeta Chatterjee testified on Thursday that Clarke was suffering from schizophrenia at the time and said it was untreated, except for two days he had spent in hospital in 2020.<\/p>\n<div class=\"c-tabs\">\n<p>\n\t\t\t<button role=\"tab\" class=\"c-tabs__tab c-tabs__tab--active\" type=\"button\">More on Crime<\/button><br \/>\n\t\t\t<button role=\"tab\" class=\"c-tabs__tab\" type=\"button\">More videos<\/button>\n\t\t<\/p>\n<\/p><\/div>\n<p>Chatterjee testified that Clarke was experiencing paranoid delusions and sensory and auditory hallucinations in the form of voices.<\/p>\n<p>\u201cThe voices were constant, many were derogatory, command in nature and threatening,\u201d she told Superior Court Justice Maureen Forestell. Chatterjee said Clarke attributed the voices to the people at the building he had lived in, including the victim.<\/p>\n<p>She said at the time of the shooting, Clarke was in a psychotic state. It\u2019s fairly easy to get one. All you have to do is get two people to sign off on it and as long as you have no criminal background, they\u2019re not checking anything medically,\u201d said Sevag. \u201cEssentially if you have a clean record, guess what? You can get a gun.\u201d<\/p>\n<p>Closing submissions will be heard next week.
