{"id":14874,"date":"2025-01-30T09:47:06","date_gmt":"2025-01-30T09:47:06","guid":{"rendered":"http:\/\/torontotribune.ca\/index.php\/2025\/01\/30\/latest-accused-iran-official-caught-in-canada-sues-immigration-department\/"},"modified":"2025-01-30T09:47:06","modified_gmt":"2025-01-30T09:47:06","slug":"latest-accused-iran-official-caught-in-canada-sues-immigration-department","status":"publish","type":"post","link":"https:\/\/torontotribune.ca\/index.php\/2025\/01\/30\/latest-accused-iran-official-caught-in-canada-sues-immigration-department\/","title":{"rendered":"Latest accused Iran official caught in Canada sues immigration department"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"\">\n<p>The latest suspected senior Iranian official caught in Canada sued the immigration department and enlisted a Liberal MP\u2019s office as part of her fight to stay in the country, government records show.<\/p>\n<p><\/p>\n<p>After arriving in Canada as a tourist, Elham Zandi applied for a work permit, and when officials investigated her past, she complained to the courts about the delay and sought $10,000 in damages.<\/p>\n<p>Her immigration file also reveals the office of Liberal MP Patrick Weiler contacted <a href=\"https:\/\/globalnews.ca\/tag\/immigration-refugees-and-citizenship-canada\/\">Immigration, Refugees and Citizenship Canada<\/a> no less than five times about her case.<\/p>\n<p>Now the <a href=\"https:\/\/globalnews.ca\/tag\/canada-border-services-agency\/\">Canada Border Services Agency<\/a> is accusing Zandi of being a senior member of Iran\u2019s repressive regime and has launched deportation proceedings against her, Global News has learned.<\/p>\n<p>Zandi\u2019s lawyer declined to comment. The CBSA said it could not discuss the matter for privacy reasons. Three have had hearings so far. The IRB issued deportation orders against two of them but declined to expel the third.<\/p>\n<p>A fourth official left Canada voluntarily. Another six cases are still before the IRB. The policy was a response to Tehran\u2019s suppression of <a href=\"https:\/\/globalnews.ca\/news\/10752432\/women-life-freedom-iran-regime-officials-canada-deportations\/\">Woman, Life, Freedom<\/a> movement protesters.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad c-ad--tallSticky\">\n<p>Story continues below advertisement<\/p>\n<\/p><\/div>\n<p>However, according to immigration documents released to Global News by the Federal Court, Zandi was able to enter Canada for \u201ctourism\u201d and then apply to stay on as a temporary resident worker.<\/p>\n<p>Her application was made on Nov. 7, 2023 under the <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/mandate\/policies-operational-instructions-agreements\/public-policies\/iran-nationals-extend-stay-extension.html\">Iran public policy<\/a>, which is meant for those who \u201cfeel uncomfortable returning to Iran\u201d as a result of the regime\u2019s killing and mass arrests of women\u2019s rights activists.<\/p>\n<p>Two months later, either Zandi or a representative acting on her behalf, \u201ccommenced a series of status enquiries with the office of Patrick Weiler, a Member of the House of Commons Canada,\u201d according to immigration records.<\/p>\n<p>A staff member in Weiler\u2019s office began asking in January 2024 about the progress of Zandi\u2019s immigration case and followed up in February, March, July and September, according to the immigration documents.<\/p>\n<p>During that time, Weiler defended the government\u2019s record on Iran in the House of Commons, reminding MPs about the 2022 decision to ban top Iranian officials from Canada.<\/p>\n<p>\u201cAs a result, senior officials of the regime are now permanently inadmissible to Canada,\u201d <a href=\"https:\/\/www.ourcommons.ca\/documentviewer\/en\/44-1\/house\/sitting-299\/hansard#Int-12678914\">he said<\/a> during an April 15, 2024 debate about whether to add the IRGC to Canada\u2019s list of terror groups.<\/p>\n<p>\u201cThis includes tens of thousands of Iranians, such as the head of state, senior IRGC members, intelligence operatives, senior government officials, diplomats and against Iran \u201csome of the strongest in the world,\u201d but raised questions about outlawing the IRGC, saying doing so could impact thousands of Canadians who had been conscripted into the Zandi\u2019s daughter was a constituent and had asked for updates on her mother\u2019s work permit application.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad c-ad--tallSticky\">\n<p>Story continues below advertisement<\/p>\n<\/p><\/div>\n<p>As a result, one of Weiler\u2019s staff spoke to IRCC\u2019s Ministerial Centre for Members of Parliament and Senators five times and relayed the responses to Zandi\u2019s daughter, his office said in a statement.<\/p>\n<p>Located in Montreal, MCMPS is the IRCC office set up to handle calls from MPs asking about the immigration cases of their constituents. Each query by an MP is noted in an applicant\u2019s immigration file.<\/p>\n<p>\u201cThe only person whom our office was in contact with was her daughter who requested case updates on her mother\u2019s behalf, a service MP offices provide to all constituents,\u201d the statement said.<\/p>\n<p>The MP\u2019s office said it was not aware of the details of Zandi\u2019s security screening and welcomed the removal of anyone found inadmissible under the 2o22 Iran policy.<\/p>\n<p>\u201cWe would like to emphasize as well that MP offices are not privy to, nor are we able to action in any way the security assessments for immigration cases,\u201d the statement said.<\/p>\n<p>\u201cThe job of constituency office caseworkers is to provide status updates on cases requested by constituents, nothing more.\u201d<\/p>\n<p>It is not the first time an MP\u2019s office has been linked to the case of an Iranian under scrutiny for possible links to the regime.<\/p>\n<p>According to court records, the office of Conservative Leader Pierre Poilievre asked for updates on Eshagh Ghalibaf in 2021.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad c-ad--tallSticky\">\n<p>Story continues below advertisement<\/p>\n<\/p><\/div>\n<p>The son of Iran\u2019s parliamentary speaker, Ghalibaf had applied to immigrate to Canada and, like Zandi, launched a court case against Canada alleging his security screening was taking too long.<\/p>\n<p>Immigration Minister Marc Miller said last February the government had <a href=\"https:\/\/x.com\/marcmillervm\/status\/1760309015647584675?s=46&amp;t=svqP6tbjneaKmWVuF6rPaQ\">refused<\/a> the permanent residency application of Ghalibaf, whose father was also once a senior IRGC commander.<\/p>\n<div class=\"l-article__part\" data-shortcode=\"section-heading\">\n<p>\n\t\t\t\t<span class=\"l-article__sectionAnchor c-sectionHeading__anchor\" id=\"zandi-demanded-visa-decision\"\/><\/p>\n<h2 class=\"c-sectionHeading__title\">\n\t\t\t\tZandi &#8216;demanded&#8217; visa decision\t\t\t<\/h2>\n<\/p><\/div>\n<div class=\"l-article__part\" data-shortcode=\"caption\">\n<figure class=\"c-figure c-figure--aligncenter c-figure--expandable\">\n<div class=\"c-figure__inner\" style=\"width:1200px;\"><figcaption class=\"c-figure__caption c-caption\">\n\t\t\t\t\t\t\t<span class=\"c-caption__desc\"><br \/>\n\t\t\t\t\tIranian Supreme Leader\u00a0Ayatollah\u00a0Seyyed Ali\u00a0Khamenei\u00a0at Islamic\u00a0Revolutionary Guard\u00a0Corps graduation ceremony, Tehran, Iran, June 30, 2018. Photo by Salampix\/ABACAPRESS.COM.\t\t\t\t<\/span><br \/>\n\t\t\t\t\t\t\t\t<\/figcaption><\/div>\n<\/figure>\n<\/div>\n<p>Six months after Zandi asked for a work permit, her Saskatoon-based lawyer, Oluwadamilola Asuni, sent IRCC a letter that complained of an \u201cunreasonable and inordinate delay\u201d and \u201cdemanded\u201d a decision by June 14.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad c-ad--tallSticky\">\n<p>Story continues below advertisement<\/p>\n<\/p><\/div>\n<p>On Aug. 5, Zandi filed a case in the Federal Court that asked a judge to order the immigration department to make a decision on her application within five days.<\/p>\n<p>The delay in processing her case was \u201cunacceptable\u201d and a breach of her \u201clegitimate expectation,\u201d said her court application, which sought reimbursement for her legal costs and another $10,000 in damages.<\/p>\n<p>She also argued she had already been screened before she came to Canada.<\/p>\n<p>The government responded in a written submission that \u201csecurity screening remains in progress\u201d and her court case should be dismissed since no decision had yet been made about her work permit.<\/p>\n<p>But last week, the IRB said the CBSA had asked for a deportation hearing for Zandi under a <a href=\"https:\/\/laws.justice.gc.ca\/eng\/acts\/i-2.5\/section-35.html\">section<\/a> of immigration law that bans\u00a0prescribed senior officials in the service of a government engaged in terrorism and gross rights abuses.<\/p>\n<p>The hearing will be held in public, the IRB said.<\/p>\n<p>Along with <a href=\"https:\/\/globalnews.ca\/news\/10264872\/canada-china-foreign-interference-elections-csis-report\/\">China<\/a> and <a href=\"https:\/\/globalnews.ca\/news\/10812678\/india-crime-canada-politician\/\">India<\/a>, the Iranian regime is one of a handful of foreign governments Canada has accused of targeting the diaspora with threats and intimidation.<\/p>\n<p>According to intelligence documents tabled at the foreign interference commission, Tehran monitors Iranian dissidents and women\u2019s rights activists in Canada to silence criticism of the regime.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad c-ad--tallSticky\">\n<p>Story continues below advertisement<\/p>\n<\/p><\/div>\n<p>Meanwhile, Canada-based crime networks have helped Iran <a href=\"https:\/\/globalnews.ca\/news\/10794949\/iran-sanctions-toronto-change-names\/\">evade sanctions<\/a> put in place to pressure the regime and curb its rights abuses and weapons and nuclear programs.<\/p>\n<p><a href=\"https:\/\/globalnews.ca\/news\/10977935\/iranian-regime-member-canada-suit-mp\/mailto:Stewart.Bell@globalnews.ca\">Stewart.Bell@globalnews.ca<\/a><\/p>\n<\/p><\/div>\n<p><script defer src=\"https:\/\/connect.facebook.net\/en_US\/sdk.js#xfbml=1&#038;appId=318812448281278&#038;version=v3.3\"><\/script><br \/>\n<br \/><br \/>\n<br \/><a href=\"https:\/\/globalnews.ca\/news\/10977935\/iranian-regime-member-canada-suit-mp\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The latest suspected senior Iranian official caught in Canada sued the immigration department and enlisted a Liberal MP\u2019s office as part of her fight to stay in the country, government records show.
