{"id":14772,"date":"2025-01-29T11:49:58","date_gmt":"2025-01-29T11:49:58","guid":{"rendered":"http:\/\/torontotribune.ca\/index.php\/2025\/01\/29\/family-files-lawsuit-after-toronto-mother-son-die-on-vacation-in-dominican-republic\/"},"modified":"2025-01-29T11:49:58","modified_gmt":"2025-01-29T11:49:58","slug":"family-files-lawsuit-after-toronto-mother-son-die-on-vacation-in-dominican-republic","status":"publish","type":"post","link":"https:\/\/torontotribune.ca\/index.php\/2025\/01\/29\/family-files-lawsuit-after-toronto-mother-son-die-on-vacation-in-dominican-republic\/","title":{"rendered":"Family files lawsuit after Toronto mother, son die on vacation in Dominican Republic"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"\">\n<p>The family of a Toronto mother and son who died after getting food poisoning during their stay at a Dominican Republic resort are now suing a hotel and travel company, alleging they were negligent in their health and safety protocols and failed to provide timely medical help.<\/p>\n<p><\/p>\n<p>April and Stephen Gougeon and their two young sons, Oliver and Wesley, travelled in December 2023 to the Viva Dominicus Beach by Wyndham resort for an all-inclusive vacation, says a statement of claim filed this week in\u00a0Ontario\u00a0Superior Court.<\/p>\n<p>Just hours after they checked in and ate dinner at the buffet, all four became severely ill, but the family\u2019s initial request for medical assistance in their room was rebuffed, the court document alleges.<\/p>\n<p>The family was eventually taken to a local hospital, where 41-year-old April Gougeon and eight-year-old Oliver died. A coroner\u2019s report in the Dominican Republic concluded they died from \u201csecondary causes related to food poisoning,\u201d according to the statement of claim.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad\">\n<p>Story continues below advertisement<\/p>\n<\/p><\/div>\n<p>Stephen Gougeon and their other son Wesley were treated at the hospital for two days before returning to Canada, it says.<\/p>\n<p>\u201cStephen and April planned this trip. They went through reputable companies, and it never crossed their mind that this would be how their vacation would start,\u201d Meghan Hull Jacquin, the lawyer representing the family, said in a phone interview Tuesday.<\/p>\n<div class=\"c-inlineSignup\" data-newsletter-inline=\"\">\n<div class=\"c-inlineSignup__image\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"170\" height=\"225\" loading=\"lazy\" src=\"https:\/\/globalnews.ca\/wp-content\/themes\/shaw-globalnews\/images\/skyline\/national.jpg\" alt=\"Get the day's top news, political, economic, and current affairs headlines, delivered to your inbox once a day.\"\/>\n\t\t\t\t<\/div>\n<div class=\"c-inlineSignup__content\">\n<h3>Get daily National news<\/h3>\n<p>Get the day&#8217;s top news, political, economic, and current affairs headlines, delivered to your inbox once a day.<\/p>\n<\/p><\/div>\n<\/p><\/div>\n<p>\u201cThis family was failed on so many fronts.\u201d<\/p>\n<div class=\"c-tabs\">\n<p>\n\t\t\t<button role=\"tab\" class=\"c-tabs__tab c-tabs__tab--active\" type=\"button\">More on Toronto<\/button><br \/>\n\t\t\t<button role=\"tab\" class=\"c-tabs__tab\" type=\"button\">More videos<\/button>\n\t\t<\/p>\n<\/p><\/div>\n<p>The family\u2019s lawsuit makes several allegations against the resort, Wyndham Hotel Canada II Inc., Air Transat Holidays and the clinic providing medical services at the resort.<\/p>\n<p>Among them are claims the defendants were negligent in handling and preparing food, including serving contaminated food and not following hygiene protocols. It also claims staff were not properly trained on food safety practices.<\/p>\n<p>The statement of claim also alleges the defendants \u201cfailed to provide a timely response to the family\u2019s call for help\u201d and had \u201cdismissed or downplayed initial complaints or signs of distress\u201d from the Gougeons.<\/p>\n<p>The allegations have not been tested in court.<\/p>\n<p>A spokesperson for Air Transat said the company is \u201cdeeply saddened\u201d by the deaths of April and Oliver.
